Motorana Intellectual Property Rights Policy

Effective Date: September 1, 2026

Motorana respects the intellectual property rights of others and expects users of the Motorana marketplace to do the same.

This Intellectual Property Rights Policy ("IPR Policy") explains how copyright owners, trademark owners, authorized representatives, and other rights holders may report content or listings that they believe infringe their intellectual property rights.

This policy applies to listings, photos, descriptions, usernames, messages where applicable, and other user-submitted content available through Motorana.

1. User Responsibility

Users are responsible for ensuring that the items they list and the content they submit do not violate the intellectual property rights of others.

You may not use Motorana to:

  • Sell counterfeit goods
  • Offer unauthorized reproductions
  • Use another person's copyrighted photographs or text without permission
  • Misuse another person's trademark
  • Falsely represent an item's source, manufacturer, authenticity, or affiliation
  • Sell products that unlawfully bear another person's trademark, logo, or copyrighted material
  • Otherwise infringe intellectual property rights

Motorana may remove or restrict content that we reasonably believe violates intellectual property rights or creates a significant infringement risk.

2. Copyright Complaints

If you believe content available through Motorana infringes a copyright that you own or are authorized to enforce, you may submit a copyright infringement notice.

A valid notice should include:

  1. Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
  2. Identification of the Motorana content you claim is infringing, including enough information for us to locate it, such as a listing URL, listing identifier, or other specific description.
  3. Your name and contact information, including an email address at which we can reach you.
  4. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

3. DMCA Notices

Motorana intends to respond to copyright notices that substantially comply with the Digital Millennium Copyright Act ("DMCA"), where applicable.

A DMCA notice should contain the information required by 17 U.S.C. § 512(c)(3).

Motorana may forward a copy of a copyright complaint, including the complainant's contact information, to the user who submitted the affected content.

Motorana may also preserve records relating to the complaint as reasonably necessary to investigate the matter, comply with legal obligations, or enforce our policies.

4. Counter-Notifications

If content you submitted was removed or disabled because of a copyright complaint and you believe the removal resulted from mistake or misidentification, you may submit a counter-notification where permitted by law.

A counter-notification should include:

  1. Identification of the content that was removed or disabled and the location where the content appeared before removal.
  2. A statement under penalty of perjury that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number.
  4. A statement consenting to the jurisdiction of the appropriate United States federal district court as required by the DMCA and agreeing to accept service of process from the person who submitted the original copyright notice or that person's agent.
  5. Your physical or electronic signature.

Motorana may restore content after receiving a valid counter-notification when permitted by applicable law.

5. Trademark Complaints

If you believe a Motorana listing or other content infringes a trademark that you own or are authorized to enforce, you may submit a trademark complaint.

Your complaint should include:

  • Your name and contact information
  • Identification of the trademark at issue
  • The registration number and jurisdiction, if the trademark is registered
  • Identification of the listing or content you believe infringes the trademark
  • A description of why you believe the use is infringing
  • A statement that you have a good-faith belief that the use is not authorized by the trademark owner or otherwise permitted by law
  • A statement that the information you provide is accurate and that you are the trademark owner or are authorized to act for the trademark owner
  • Your physical or electronic signature

6. Counterfeit Goods

Counterfeit goods are prohibited on Motorana.

Motorana may remove a listing where we reasonably believe that an item:

  • Bears a counterfeit trademark
  • Is falsely represented as being manufactured by or affiliated with a brand
  • Uses unauthorized branding in a manner likely to mislead buyers regarding authenticity
  • Is otherwise an unlawful counterfeit item

Motorana may request additional information from a seller regarding an item's source or authenticity.

Nothing in this policy requires Motorana to authenticate goods or independently determine whether an item is genuine.

Buyers remain responsible for evaluating items before completing a transaction.

7. Automotive Parts, Branding, and Compatibility References

Motorana is a marketplace for vehicle parts, so listings may legitimately refer to vehicle manufacturers, brands, models, part numbers, and compatibility information.

For example, a seller may need to identify a part as being compatible with a Toyota Tacoma or removed from a BMW 325i.

The use of a brand name solely to accurately identify an item, describe compatibility, or explain the intended use of a part may be permissible.

Users may not, however, use trademarks or other branding in a misleading manner that falsely suggests that:

  • Motorana is affiliated with or endorsed by a vehicle manufacturer
  • A seller is an authorized dealer when they are not
  • A third-party or aftermarket part is an original manufacturer part when it is not
  • A product has been sponsored, certified, approved, or manufactured by a brand when that is not true

Sellers should clearly identify aftermarket, replica, reproduction, refurbished, or third-party parts where that information is relevant to the listing.

8. Photos and Listing Content

Users should upload photographs and listing descriptions that they created themselves or that they otherwise have permission to use.

Copying photographs, product descriptions, diagrams, manuals, or other protected material from manufacturers, retailers, other marketplaces, or other sellers may infringe copyright.

Motorana may remove such content after receiving a valid complaint or otherwise becoming aware of infringement.

9. Repeat Infringers

Motorana may suspend or terminate users who repeatedly infringe intellectual property rights.

In determining whether action is appropriate, Motorana may consider factors including:

  • The number of valid complaints received
  • The nature and seriousness of the alleged infringement
  • Whether the user has previously received warnings or removals
  • Whether the conduct appears intentional or fraudulent
  • Whether complaints relate to counterfeit goods
  • Other relevant circumstances

Motorana may also take immediate action in response to serious infringement even if a user has not previously received a complaint.

10. Removal and Enforcement

When Motorana receives a sufficiently detailed intellectual property complaint, we may:

  • Review the identified content
  • Request additional information from the complainant or user
  • Remove or disable access to a listing or other content
  • Notify the affected user
  • Restrict the visibility of content
  • Suspend or terminate accounts
  • Prevent relisting of prohibited content
  • Preserve relevant records
  • Take other action reasonably necessary to protect users, rights holders, or Motorana

Removal of content does not mean that Motorana has made a final legal determination regarding infringement.

Motorana may act conservatively where a listing presents a substantial counterfeit, fraud, or infringement risk.

11. Misrepresentations and Abuse of the Reporting Process

Intellectual property complaints and counter-notifications must be submitted in good faith.

Knowingly submitting false, misleading, or fraudulent claims may result in legal liability.

Motorana may reject, disregard, or restrict complaints that appear abusive, fraudulent, incomplete, or unrelated to legitimate intellectual property rights.

Motorana may also restrict users who repeatedly misuse the reporting process.

12. Information We May Share

In connection with an intellectual property complaint, Motorana may share information contained in a complaint or counter-notification with:

  • The user who submitted the disputed content
  • The complaining rights holder or authorized representative
  • Service providers assisting with complaint processing
  • Courts, government agencies, or other parties when required by law

For copyright matters, certain identifying information may need to be exchanged between the complainant and the affected user as part of the DMCA process.

Do not submit information in a complaint that is unnecessary to evaluating or processing your request.

13. Motorana's Role

Motorana provides a marketplace platform and generally does not create or control user listings.

Motorana does not pre-screen every listing for potential intellectual property infringement and is not responsible for guaranteeing that every item or listing is non-infringing.

Motorana nevertheless reserves the right to remove content, restrict listings, or take action against users where appropriate under this policy, the Motorana Terms of Use, or applicable law.

14. No Legal Advice

Motorana cannot determine your legal rights for you.

Submitting a complaint does not guarantee that content will be removed, and declining to remove content does not mean Motorana has determined that the content is lawful.

If you are uncertain whether content infringes your rights, you may wish to consult an attorney before submitting a complaint.

15. Changes to This Policy

Motorana may update this IPR Policy as the marketplace, applicable law, or our enforcement practices evolve.

If we make material changes, we will update the effective date above and provide additional notice where appropriate.
